Emotide: Privacy Policy & End-User License Agreement

PART 1: PRIVACY POLICY

This Privacy Policy explains how Emotide ("we," "us," or "our") manages information. We believe that your sensitive health data is your own, and our application is built to reflect that principle.

1. Local-Only Data Processing

Emotide is a heartbeat recording and monitoring application. Our core functionality is designed to protect your privacy:

Heartbeat Data: All recording, analysis, and storage of your heart rate data and pulse waves are performed locally on your device.

No Cloud Storage: We do not upload, store, or transmit your biometric or health-related data to our servers.

Sensor Access: The app requires access to your device’s camera or specialized sensors to detect your pulse. This raw sensor data is processed in real-time on the device and is not saved externally.

2. Third-Party Platforms, Analytics, and Attribution

To ensure the stability of the app and to help us grow, we use limited third-party services. These services may collect technical, non-identifiable information:

Firebase (by Google): We use Firebase for crash reporting (to identify and fix software bugs) and basic app usage analytics.

Attribution & Data Analytics (e.g., Adjust, AppsFlyer): These tools help us understand how users find our app (marketing attribution) and which features are most frequently used.

Data Collected: These third parties may collect technical identifiers such as your Advertising ID (GAID or IDFA), device model, and operating system version. They do not have access to your heartbeat recordings or health data.

3. Legal Basis for Processing

We process information under the following legal frameworks:

Contractual Necessity: Processing local heartbeat data is necessary to provide the monitoring service you have requested.

Legitimate Interests: We use technical, pseudonymized data via third-party providers to maintain app performance, fix crashes, and optimize our marketing efforts.

Consent: For any optional data collection or tracking, we rely on the consent you provide via system-level permissions.

4. Your Data Rights

Regardless of our local-processing model, we respect your rights under global data protection laws (such as GDPR and CCPA):

Right to Access: You have the right to request access to any personal data we may hold about you (such as support emails or technical logs).

Right to Rectification: You may request that we correct any inaccurate or incomplete personal data we have collected.

Right to Deletion: You can request the deletion of your personal data. Note that deleting the Emotide app from your device automatically erases all local heartbeat history.

Right to Know About Sharing and Selling: You have the right to know if your data is shared or sold. Emotide does not sell your personal data. We only share non-sensitive technical identifiers with the service providers listed in Section 2 for app optimization.

Right to Know About Sharing: You have the right to be informed about the specific third parties with whom your data (technical identifiers) is shared.

5. How to Opt-Out of Data Sharing or Selling

Since we do not "sell" data in the traditional sense, your primary method of control is through "sharing" technical identifiers. You can exercise your right to opt-out by:

Device Settings: On Android or iOS, you can go to your system settings and select "Limit Ad Tracking" or "Opt-out of Interest-Based Ads."

App Permissions: You can revoke sensor or file permissions at any time through your device's application manager.

6. Data Retention Policy

Local Health Data: Your heartbeat records remain on your device as long as the app is installed. We do not have a copy of this data; therefore, we cannot retain it if you delete the app.

Technical Data: Technical data collected by third-party analytics partners is typically retained for a period of 14 to 26 months for trend analysis, after which it is deleted or fully anonymized.

Support Communications: If you contact us for support, we retain your email and communication history only for as long as necessary to resolve your issue.

8. Right to Complain to a Regulator

PART 2: END-USER LICENSE AGREEMENT (EULA)

1. Grant of License

Emotide grants you a personal, non-exclusive, non-transferable, and limited license to install and use the Application on your mobile device for personal, non-commercial purposes.

2. Medical Disclaimer

Emotide is NOT a medical device. The heartbeat recordings and insights provided are for informational and wellness purposes only. It should not be used for medical diagnosis, treatment, or prevention of any heart condition. Always seek the advice of a qualified physician with any questions regarding a medical condition.

3. Restrictions

You agree not to:

Decompile, reverse engineer, or attempt to derive the source code of the Application.

Use the Application for any unlawful purposes.

Modify or remove any proprietary notices or branding from the Application.

4. Intellectual Property

The Application, its original content, and its features are the exclusive property of Emotide and its licensors. Your use of the app does not grant you ownership of any intellectual property rights.

5. Limitation of Liability

To the maximum extent permitted by law, Emotide shall not be liable for any damages (including health-related issues, data loss, or device failure) arising from your use or inability to use the Application.

6. Termination

This Agreement is effective until terminated by you (by deleting the app) or by us. We reserve the right to terminate this license if you breach any terms of this Agreement.
